NI NDE UGUMYA GUSHUKA ABAHUTU KO BAKIRI BA NYAMWINSHI MU RWANDA ?

Murantunga niba iki kibazo cyanjye mubona ari nta shingiro gifite, ariko njye ndambiwe ibi binyoma bikomeza. Ngo Abahutu ni ba nyamwinshi mu Rwanda. Imvo n’imvano yo kuri uyu wa gatandatu taliki ya 6 Nzeri 2014 (kanda aha imvo n’imvano), nayo yunze mu mvugo za bamwe mu Banyarwanda n’Abazungu pe ! Izo mvugo zemeza ko ngo impamvu Abatutsi bihambira ku butegetsi, ari ukubera gutinya ko Abahutu baramutse babusubiranye, Abatutsi baba babuze umutekano. Impamvu ituma ibi bivugwa ngo ni ukubera ko Abahutu ari “Banyamwinshi”, Abatutsi bakaba “Banyamuke”. Bongera ho ko Abahutu ari “Abicanyi ku buryo bwa kamere” ngo ku buryo baramutse babonye ubutegetsi, barimbura Abatutsi. Jye rero bene izi mvugo ziranyobera. Uretse ko abo Bahutu bose badashobora kujya ku butegetsi, kimwe n’uko n’Abatutsi bose batabufite, hari n’uko bamwe mu Banyarwanda n’Abanyamahanga, basa nk’abahagamye mu mwaka w’i 1994, ku buryo ibyakurikiyeho badashaka kubirebesha amaso yabo. Ibyerekana ko Abahutu atari banyamwinshi mu Rwanda

Tudatinze ku bahutu bishwe ubwo FPR yari ikiri mu ntambara, n’abo yarimbuye imaze gufata ubutegetsi, Abahutu bapfuye nyuma baruta kure Abatutsi batahutse mu Rwanda nyuma ya 94. Mu mwaka w’i 1996, perezida Kagame yaragize ati : “Harya abo biyita ba nyamwinshi, uwabagira banyamuke yaba iki ?”. Iryo jambo akimara kurivuga, nibwo yatangije ya gahunda yise “2020”. Iyo gahunda igamije ngo gukiza “Abanyarwanda bose”, yagombye kumvikana nko gukiza “Abatutsi bose”, n’ubwo bigaragara ko bitari gushoboka. Guhera icyo gihe, gahunda ya Kagame yo “Kurangiza amazi mu ngunguru akoresheje akayiko” yatangiye gushyirwa mu bikorwa. Kuva ubwo, Abahutu batangira kwicwa umusubizo: Barapfuye mu mashyamba ya Congo, baricwa bari mu nzira y’ihunguka. Babona imisozi y’i Rwanda bakarwara, ngo wapfa Kagame aratumaze. Abenshi muri bo, bahisha ko ari n’Abanyarwanda. Bafashe ubwene gihugu bw’aho bari, mu gihe Abatutsi bo baba hanze, bose bitwa Abanyarwanda nk’uko maze kubivuga.
  • Iyo utembereye mu Rwanda, ukareba abari mu buyobozi hafi ya bose, ukitegereza igisirikari n’igipolisi, simvuze abakozi babarirwa ahari amafaranga, za kaminuza ntiwareba. Wibaza impamvu hari abantu bakigumya kwibeshya ngo Abahutu baracyari ba nyamwinshi mu Rwanda.
  • Nta kugumya kwibeshya : Abafite imyanya ikomeye mu Rwanda no mu Buganda, bose ni ibiryango bikomeye by’Abatutsi.Ubona iyo baba Abatutsi b’Abaganda cyangwa b’Abarundi gusa! Baba mu Buganda, Burundi, Congo n’ahandi, bafite n’ibyangombwa by’ubunyarwanda. Uvuga ko mbeshya, ajye kubaza icyo Jacques Nziza apfana na Kale Kayihura ushinzwe iperereza mu Buganda. Si no mu Buganda gusa. No muri Congo ni nk’uko. Harya Bisengimana uyobora polisi n’ipererza muri Congo si umunyarwanda ? Amateka ya perezida Kabila uyobora Congo nayo ahishe byinshi…
  • Njye maze no kumirwa iyo nitegereje abanyamikino (sport), abahanzi, n’abayobora amadini yo mu Rwanda. Abo Bahutu bitwa ba nyamwinshi bagaragarira he? Kereka niba bagaragara muri ziriya nkomamashyi babeshya ngo zifite ubutegetsi, zajya kwicisha bene wabo zigakura agahu ku nyo !

Dore aho Abahutu bakiri ba nyamwinshi mu Rwanda

  • Iyo ugeze muri gereza zose zo mu Rwanda, aha uhasanga Abahutu benshi koko.
  • Wanyarukira muri ya milimo y’uburetwa bushya bwitwa ngo T.I.G. (imilimo y’insimbura gifungo), aha naho uhasanga Abahutu gusa gusa.
  • Ahandi usanga abana b’Abahutu benshi, ni mu kirwa cya Iwawa. Hahandi bogereza ubwonko abana b’Abahutu, bakabaha utuzi tubica gahoro gahoro, iyo batabakonnye, kugira ngo batazongera kubyara.
  • Abahutu ba nyamwinshi uzabasanga kandi muri babandi basenyerwa, bakicwa n’inzara, bakaba barwaye amavunja, none bageze n’aho bumva ko ari uko Imana yabigennye ! Umunyamakuru wa Therwandan arambaza icyo ntekereza kuri gahunda ya Kagame yo gukomeza gufunga abasilikari bakuru ?

Icy’ingenzi mbona twese dukwiye gusobanukirwa ni « philosophie » iri inyuma y’ibi bikorwa bitindi bya Kagame. Ndareba ngasanga iyo « philosophie » ihagarariye ku maguru nk’atatu y’ingenzi :

1. Guhera kuri Coup d’Etat yo mu 1973 kugeza uyu munsi ,ubutegetsi bwo mu Rwanda ntibwiyubakiye ku ndangagaciro za « politiki » ahubwo bwubakiwe ahanini ku gitugu cya gisilikari. « Umusirilari ni we mutware ».  Muri rusange, Abanyapolitiki b’abasivili bahawe imyanya y’udukingirizo dushinzwe gukora ibyo abasilikari bashaka byonyine. Ibyo ahanini ni nabyo byabaye intandaro yo gutsindwa intambara y’Inkotanyi yatangiye mu 1990, gutsindwa  urugamba rwa politikibikaba byarabanjirije ugutsindwa urugamba rw’amasasu. N’ubu iyo myumvire y’ « umusilikari ni we  mutware » ni kimwe mu bivangira Opozisiyo muri iki gihe, bigatuma gutera umutaru bigorana cyane. Iyo myumvire ni nayo igiye kubirindura ubutegetsi bwa Kagame, kandi dore ntibigitinze.

2. FPR yo noneho imaze gutsinda intambara mu 1994, yashyize ubutegetsi BWOSE mu biganza by’agatsiko k’abasilikari batari na bo ! Umujenerari wabyigiye , akagira  n’ibindi azi, ashobora no gukora politiki neza. Abo sibo Kagame akeneye.  FPR yahisemo kubakira igihugu ku« bukorikori » bw’abasilikari bato (bazamurwa mu ntera bidashingiye ku bushobozi…),b’inzobere mu bwicanyi (terroristes), bataranganwa  umutima wita ku neza y’umuturage . Higijweyo  abasilikari bakuru bazi ubwenge (bashinjwa kuba intellectuals), abadakuyemo akabo karenge inzira zikigendwa, baradindizwa, barafungwa ab’amahirwe makeya  bahondwa akandoya mu mutwe. Ibyo nta gihe FPR itabikoze, guhera mu ishyamba kugeza n’uyu munsi !

3. Kuba muri iyi minsi Kagame atangiye kwibasira abagize Agatsiko kari kamukikije mu bihe byahise, birababaje ariko nta gitanza kirimo. Impamvu benshi mu Banyarwanda babikubita amaso bakinumira ni uko bazi neza ko Kagame asa n’ufite uburenganzira budasanzwe bwo gukora amahano ahora akora, nta nkurikizi : 

(1) Kwica no kurimbura umuhutu nta cyaha kirimo, byarakiriwe, bihabwa umugisha n’abakagomye kubyamagana. Ubuhanga bwa kinyarwanda bwo buti :  Inkoni ikubise mukeba, jya wihutira kuyirenza urugo !

(2)Kagame yumva ko Abatutsi bose bo mu Rwanda ari ingaruzwamuheto ze, ndetse nabo ubwabo bakumva ko ari AMATUNGO ye , yicamo ayo ashatse , igihe abishakiye. Abatutsi barabimwemereye, dore imyaka ishize ari hafi 25, uretse abavugira mu matamamatama, nta tsinda rigaragara Abatutsi bigeze bashinga ngo rigaragaze ko ryamaganye imyumvire n’imigirire ya Kagame. Iyo Kagame afashe icyemezo cyo kubamba umwana w’imfubyi warokotse jenoside nka Kizito Mihigo, bikavugwa ko uwo mwana yashakaga kwica Kagame akoresheje indirimbo ahimba, biratangaje kubona abakagombye kumuvuganira aribo batera hejuru ngo Kizito nabambwe ku musaraba ! Kagame azineza ko ashobora kubica uko yishakiye, nta rundi rubanza ! Kandi ntasiba kubikora.

(2). Kagame yumva ko Abasilikari ba FPR  bose uko bagana ari umutungo we bwite (propriété privée), agenga uko yishakiye. Ikibabaje kurushaho ni uko Kagame abakubita inshyi buri munsi ndetse yagera aho akanabasebya ku mugaragaro, mu mbwirwaruhame !  Paul Kagame yabivuze kenshi no mu buryo bwinshi ko « aba Généraux » be ari abantu badafite icyo bashoboye, ko ari ibigarasha, Isazi, IBIRURA….ko yewe  ari abantu badafite icyo bimariye ku buryo ndetse muri bo nta n’umwe washobora no KUROTA yakoze kudeta ! Ibyo Abasilikari be barabyumvise nyamara ntibigeze berekana ko batabyemera, barakomeje baramwumvira, bakora « akazi » kose abahaye, abana batikirira mu ntambara z’urudaca za Kongo….. Abageragaje gutera ijwi hejuru  ni ba Liyetona Jenerali Kayumba Nyamwasa ariko na we ntiyabikoze  akiyobora izo ngabo, yategereje kubanza  kwamburwa ububasha bwose, noneho yihutira gukiza amagara ye yonyine yifatira iy’ubuhungiro ! No mu buhungiro kandi agomba guhora yihishe kuko nta cyemeza ko ubutaha noneho Kagame  azamuhusha !

Umwanzuro

Niba Kagame akora amarorerwa ni ukubera ko:

(1) Abatutsi bakomeje kwemera Kagame nk’Imana yabo, ibagenera ikibakwiye, ikabaha ubuzima cyangwa urupfu.  Umunsi habonetsemo ab’inkwakuzi bagahindura imyumvire, bagafata gahunda yo kwisuganya no kwivuganira, mu Rwanda hazaba impinduka yihuse

(2)Birasa n’aho Abasilikari be bamusinyiye « chèque en blanc” ngo ajye ababaga nk’ukerera amatungo yiyororeye, nta zindi nkurikizi! Umunsi bakangutse bakumva ko bashobora kumwambura urwo ruhushya rutindi, uwahekwaga azigenza, nko mu kanya ko guhumbya ijisho.

(3) Njyewe , Padiri Thomas Nahimana, ndamutse mfite imbunda irimo amasasu nibura abiri, ntabwo Kagame yankubita inshyi ampora ubusa nk’uko ahora anyuka aba “Generaux” be, ngo mureke agende…..! Na we ava amaraso atukura di ! Amahirwe nyine ni uko ntari mu ngabo ze, nkaba ndateze no kuzibamo ! Niyiryamire asinzire.

Muri make,  Abasilikari ba RDF n’Abatutsi barokotse jenoside, nibahitamo  gukomeza kwiberaho nk’ISENENI Kagame afata zibibona, agashyushya amazi zireba, akazitereramo zikanuye amaso, akazirya ziyaturumbuye…..inzira y’umusaraba iracyari ndende kandi nyamara yashoboraga kuba UBUSAMO.

Banyarwanda nimukanguke, dufatanye kubuza Kagame gufata abenegihugu nk’amatungo ye. Ibyo birahagije. Nabeho atureke natwe twibereho, nta kindi tumusaba.

Hashize iminsi mu Rwanda havugwa itabwa muri yombi rya bamwe mu basirikare bakuru bo mu ngabo z’u Rwanda RDF. Ni igikorwa Kagame yatangiye hakaba hagiye gushira imyaka itanu. Iki gikorwa cyaje gikurikiye inyandiko  yo mu mwaka wa 2010 yiswe Rwanda Briefing yanditswe n’abagabo bane (Kayumba Nyamwasa, Patrick Karegeya,  Gerard Gahima na Theogene Rudasingwa) bahoze mu buyobozi bwo hejuru bw’ingabo z’u Rwanda n’ubw’ishyaka FPR.

 

Muri iyi nyandiko, bimwe mu byo aba bagabo binubiraga, harimo ko FPR ikomeje gukandamiza Abanyarwanda ku nyungu za Kagame wenyine n’umuryango we, ariko cyane cyane Abahutu bakaba bakomeje kwigizwayo mu myanya ifatirwamo ibyemezo, bikaba biramutse bidakosowe nta shiti u Rwanda rwazongera rukagwa mu bibazo bya genocide. Aba bagabo ntibarekeye aho kuko bahise bashinga n’ishyaka RNC  rigamije kurwanya ubutegetsi bwa Kagame no kubusimbuza ubunogeye Abanyarwanda bose.

N’ubwo bwose Abanyarwanda bamwe batekereje ko RNC itageza ku Banyarwanda ibyiza,  mu gihe abayishinze batabanje gusaba imbabazi ku byaha  by’indengakamere FPR yakoze dore ko na bo bahoze mu bari mu bayikuriye, Kagame we yabonye RNC nka rimwe mu mashyaka ashobora kumuhungabanya. Ikindi cyakurikiyeho ni icyoba Kagame yatewe no gukeka ko RNC yaba ikorana na bamwe mu basirikare ba RDF bari inkoramutima za Kayumba na Karegeya. Maze ahera ubwo yirara mu basirikare be ntiwareba: Colonel Rugigana murumuna wa Nyamwasa arafungwa,Karegeya anigishwa ikiziriko Rujugiro ibintu bye birafatirwa, Kayumba baramuhusha, none mu minsi ishize mwumvise ibyabaye.

Colonel Byabagamba yarafunzwe, General Rusagara ni uko, David Kabuye umugabo wa Rosa Kabuye arafungwa, ndetse Rosa (umufasha wa Kabuye) na Baine (umufasha wa Byabagamba) bashyirwa mu birura byataye umurongo!

Icyo ibi bisobanuye ni uko Kagame ageze kure aho atagishobora kumenya inkoramutima n’umwanzi we haba mu gisirikare ndetse no muri FPR. Muri politiki ikosa rikomeye kurusha ayandi ni ugufata umwanzi ukamwita umukunzi cyangwa se umukunzi ukamwita umwanzi kuko biganisha ku gutsindwa. Ibi ni byo Kagame yibereyemo kandi yaba abikora abizi, cyangwa se abikora ari amaburakindi ntibizabura kumugaruka. Second Genocide in Rwanda? Slow, Silent, and Systematic?

What is happening in Rwanda? On Aug. 26, the BBC reported that Burundian officials are investigating to determine why Rwandan bodies have been found floating in Lake Rweru, on Burundi’s border with Rwanda.

The discovery is not only gruesome but also ominous because both East African nations suffer from extremely volatile Hutu-Tutsi ethnic rivalries rooted in centuries of Hutu oppression by a feudal Tutsi aristocracy, which became a colonial elite in the 18th and 19th centuries.

Attempts to institute European democracy, between 1959 and 1961 in Rwanda, and in 1993 in Burundi, turned the existing social order upside down, giving electoral advantage to the Hutu majorities, which the Tutsi minorities refused to accept. War, genocide and massacres ensued and both nations, neither of which is yet 100 years old, are commonly described as tinderboxes awaiting a match.

Rwanda’s President Paul Kagame is a Tutsi, Burundi’s President Pierre Nkurunziza a Hutu. Despite past alliances of convenience, they are now antagonists. In 1993, Burundi’s Tutsi military elite assassinated that country’s first democratically elected president, Hutu Melchior Ndadaye, triggering genocidal massacres of both ethnicities in Burundi and escalating fears of the same – which did indeed follow – in Rwanda.

In 1994, near the end of a four year war of aggression, Kagame ordered the assassination of both Rwanda and Burundi’s Hutu presidents by shooting their plane out of the sky on April 6, 1994, and then launched a carefully planned, U.S. backed military offensive to seize power and restore Tutsi rule in Rwanda, even as the country sank into chaos and genocidal massacres of both ethnicities.

Any conclusion that the bodies floating in the lake are victims of state execution, genocidal execution or both could be incendiary within the two countries and/or between them. That incendiary potential has been manipulated by both foreign and domestic elites, who are no doubt following this story closely, and most likely attempting to control its outcomes.

These bound and bagged bodies certainly have the look of state execution, genocidal or not, and the simple conclusion that they were state executions has incendiary potential in itself. Rwandan President Paul Kagame arrested three of his own top military officers last week, as resistance continued to rise within his own Tutsi elite.

Rwandan or Burundian bodies?

Burundian official Jean Berchmans Mpabansi told the BBC that, ‘‘The victims are not Burundian citizens because the bodies are coming from Akagera River flowing from Rwanda.”

The Voice of Burundi reported, translated here from the French: “In recent days corpses wrapped in plastic bags are found floating on Lake Rweru on the border between Burundi and Rwanda in Muyinga Province.

“More than 40 bodies floating in the Rweru Lake town of Giteranyi have been seen and counted since the month of July by the fishermen, as confirmed by the local administration and police. This week, these fishermen, accompanied by a unit of the Navy, saw two bodies on the mouth of the Akagera.”

Rwandan Police said that no one has been reported missing in Rwanda, and Burundian Police said the same about Burundi. Both claims are unlikely because the national police of any country of 10 or 11 million people is sure to have a list of missing persons at any given time.

It’s particularly unlikely in the case of Rwanda, because on May 16, Human Rights Watch reported that “an increasing number of Rwandans have been forcibly disappeared or reported missing” and that some were known to have been forcibly disappeared by Rwanda’s army, the Rwandan Defense Force. HRW detailed 14 cases of missing persons.

In mid-July HRW spoke to the anniversary of the murder of Gustave Makonene, coordinator of Transparency International Rwanda’s Advocacy and Legal Advice Center in Rubavu, Rwanda:

“The details of Gustave Makonene’s death are gruesome. His body was found outside the lakeside town of Rubavu, in northwestern Rwanda, on July 18, 2013. The police medical report indicated he was strangled. Local residents who saw his body gave Human Rights Watch more graphic detail. They believed his body may have been thrown from a car on a road above the lake and ended up twisted around a large tree, which had blocked its fall into the water.“

There have been neither investigations nor charges. Another HRW essayist asked, “Why is the whole world still silent on the murder of Rwandan activist Makonene?” On August 1 Transparency International issued a press release saying that the staff of all five of their Rwandan offices are in danger.

President Paul Kagame’s plausibility problem

Rwandan President Paul Kagame has never been noted for plausible or consistent explanation. After 18 years of Rwandan invasion, occupation, assassination and resource plunder in the Democratic Republic of the Congo, all copiously documented, he continues to tell Western television audiences that he cannot be held responsible for the problems of Congo, that Congo’s problems began with colonialism long before his birth.

And, of course, he continues to say that his destiny is to save and forever protect the Rwandan people from genocide, because, as he tells the story over and over, the world abandoned Rwanda in 1994. It’s a matter of record that Kagame himself threatened to fire on U.N. troops if they attempted to intervene in Rwanda in 1994, but that’s never been of concern to corporate broadcast anchors. Neither has Kagame’s U.S-backed invasion of Rwanda, commanding a detachment of the Ugandan army in October 1990. Nor has the four year war that those Ugandan troops waged in Rwanda between October 1990 and July 1994. Nor has the active intervention of the Clinton Administration to prevent the UN from intervening in Rwanda in 1994.

The story of four years of war and mass killing in Rwanda has instead been shortened and simplified into a 100-day morality play about genocide ending with “Never again!”  And, Kagame has been allowed to trump all evidence and reason by playing the genocide card for so long that he feels in no way compelled to offer a plausible or consistent explanation of anything.

Nearly 50,000 people reported missing in Rwanda this year

Although Rwandan officials denied, on August 26th, that anyone is missing, the government has, on other days, acknowledged that nearly 50,000 people have disappeared this year. The government says they’re missing, but dissident Rwandan refugees and exiles say they’re dead – and that they are Hutu victims of Kagame’s slow, silent, systematic Hutu genocide – genocide by exclusion, poverty, starvation, sterilization and execution.

Rwandans whom the government acknowledges are missing include 16,000 Hutu villagers from the country’s northwestern Ngororero District. Rwandan Interior Minister James Musoni acknowledged, in the country’s Kinyarwanda language, that these villagers are missing but said that the government has no idea where they’ve gone and fears they may have crossed Rwanda’s border with DR Congo to join the Democratic Forces for the Liberation of Rwanda (FDLR).

Rwandan refugee Ambrose Nzeyimana translated the English into Kinyarwanda and posted “Kigali acknowledges the disappearance of 16,000 of its citizens” to his British-based blog, The Rising Continent. Rwandans in exile write that these people have been massacred by the Kagame regimeas part of its program to slowly, quietly, and systematically eliminate the Hutu population. Their belief is based on their own experience, their contact with extended family in Rwanda, and their attention to the Kinyarwanda press.

Rwandan prison authorities acknowledge that 30,000 Hutu prisoners sentenced to “community service” (hard labor) have also disappeared, Rwandan exiles, again, write that they’ve been executed by Kagame’s genocidal government.

It’s difficult to imagine how a government with one of the best trained, best equipped African military and security forces, including local forces everywhere, in one of the most tightly controlled, dictatorial regimes in the world, could lose track of 30,000 state prisoners. However, the government, again, and the Ibuka Tutsi survivors’ group, claim to fear that these people may have escaped across the border to join the FDLR in DR Congo, where they now constitute a threat to genocide survivors.

As with so much in Rwanda, including the history of the 1990-1994 war and genocide, there is a Tutsi version of the truth and a Hutu version, but the Tutsi version is legally enforced and championed worldwide by rich and powerful people, including Bill Clinton, Tony Blair, Rev. Rick Warren and Howard Buffett. Despite wholesale de facto discimination against Hutu people, they join Kagame in proclaiming that truth and reconciliation have been achieved in Rwanda, and ethnicity is no longer important.

Prisoners incinerated?

More Rwandan Hutu prisoners may have perished in a fire on June 5, 2014, in Rwanda’s largest prison, Muhanga Central Prison in Gitarama, and then in a second prison fire at Nyakiriba Prison in Rubavu (Gisenyi) on July 7.

Rwandan exiles write that prisoners in both Muhanga Central Prison and Nyakiriba Prison were intentionally incinerated in their cells, once again as part of a slow, silent, systematic Hutu genocide.

Is it likely that two, geographically distant Rwandan prisons would be destroyed or badly damaged by fire in barely more than one month? All we know is what Rwandan authorities say, and all they say is that there were two prison fires but no prisoners died.

Muhanga Prison, formerly known as Gitarama Central Prison, was known to be one of the most hellish prisons on earth. In 1995, a London Independent headline about it read, “Hutus held in ‘worst prison in world’: 7,000 suspects of Rwanda massacre are kept in jail built for 400.

On June 6, the International Red Cross reported that “the accommodations” of 3,500 prisoners went up in flames in Gitarama but that the Rwandan government said no prisoners were in their cells at the time.

Hard evidence?

There will be no hard evidence of the truth behind any of these missing persons reports, except perhaps those few filed by Human Rights Watch, unless the U.N. Security Council deems the situation in Rwanda so dangerous to international security and stability that an independent U.N. investigative team must be allowed in, as when U.N. investigator Hans Blix’s team was allowed into Iraq before the 2003 U.S./U.K. invasion.

Of course, the U.S. and U.K. ignored Blix’s conclusion that there were no weapons of mass destruction in Iraq, as the U.S. and allied states will ignore any evidence counter to the security interests now defined by their executive corporate, military and foreign policy elites, not by popular democracy.

However, that’s no reason not to call for investigation. It’s better that Hans Blix’s team was allowed into Iraq than not, for the sake of history and global consciousness, and we can continue to work for just outcomes. Independent U.N. investigations should be undertaken, post haste, into each instance of individual and mass disappearances in Rwanda, and into why bound, bagged bodies were found floating in Lake Rweru between the shores of Rwanda and Burundi.

Why has the U.S. renewed support for Kagame’s Rwanda?

Why did the U.S. renew its political and military support of Rwandan President Paul Kagame’s dictatorship at the U.S.-Africa Summit? Why is the U.S. threatening the Hutu refugees organized as the FDLR with military action if they refuse to disarm and surrender unconditionally?

The FDLR may be armed in self-defense, but Special Envoy to the Great Lakes Region Russ Feingold has acknowledged that they pose no credible threat to Rwanda. The majority of Rwandan Hutu refugees in eastern Congo are simply that – refugees – who dare not return to Rwanda for fear of having their names added to these long lists of missing persons that the Rwandan government says it’s unable to explain.

Rwandan opposition leaders, Hutu and Tutsi alike, and Tanzanian President Jakaya Kikwete have all called upon the Rwandan government to negotiate with the FDLR for safe repatriation to a Rwanda in which they will not be a de facto Hutu underclass threatened with elimination. ,

On January 4th, former Rwandan General Kayumba Nyamwasa told KPFA: “I understand the guiltiness that maybe some could be feeling about their failure to stop the genocide. But you don’t support somebody who’s in the process of creating another genocide. And I think they should be able to examine their consciences, look at what is happening in Rwanda, and see exactly what is taking place.”

Many Rwandan Hutus, refugees and exiles believe that if the regime now headed by Paul Kagame remains in power for another 50 years, there will be no Hutu people left in Rwanda.

African States: Reject Immunity for Leaders

(Johannesburg) – African countries should reject immunity for sitting leaders for grave crimes before the African Court for Justice and Human Rights, 141 organizations said today in a declaration in advance of an African Union meeting in Nairobi. The organizations include both African groups and international groups and have a presence in 40 African countries.

The African Union (AU) Office of the Legal Counsel is convening a meeting in Nairobi on August 25 and 26, 2014, with government officials of AU member countries in East Africa to promote ratification of AU treaties. Discussions, which will take place at the Hilton Hotel , are expected to include a newly adopted protocol to extend the African Court’s jurisdiction to trials of genocide, war crimes, and crimes against humanity, while providing immunity for sitting leaders and other senior officials. The protocol to expand the authority of the African Court was adopted at the 23rd African Union summit, in Malabo in June.

“The immunity provision is a regrettable departure from the AU’s Constitutive Act, which rejects impunity under article 4,” said George Kegoro, executive director of the International Commission of Jurists-Kenya. “Immunity takes away the prospect that victims can access justice at the African court when leaders commit atrocities. African states should take a clear stand opposing this immunity.”

The adopted Protocol on Amendments to the Protocol on the Statute of the African Court of Justice and Human Rights is the first legal instrument to extend a regional court’s authority to criminal jurisdiction over genocide, war crimes, and crimes against humanity. The protocol also covers 11 additional crimes and notably provides for an independent defense office.

But Article 46A bis of the amendments provides immunity for sitting leaders, stating: “No charges shall be commenced or continued…against any serving African Union Head of State or Government, or anybody acting or entitled to act in such capacity, or other senior state officials based on their functions, during their tenure of office.”

The statutes of international and hybrid international-national war crimes tribunals reject exemptions on the basis of official capacity. Other international conventions, including the Convention against Torture, the Convention on the Prevention and Punishment of the Crime of Genocide, and the Geneva Conventions of 1949, recognize the crucial importance of accountability for serious crimes.

“Granting immunity to sitting officials is retrogressive, and risks giving leaders license to commit crimes,” and Timothy Mtambo executive director at Malawi’s Centre for Human Rights and Rehabilitation. “Immunity also risks encouraging those accused of the crimes to cling to their positions to avoid facing the law.”

Some African countries like Benin, Burkina Faso, Democratic Republic of Congo, Kenya, and South Africa rule out immunity for sitting officials for serious crimes under their national laws, the groups said.

This text of the group declaration was drafted by Malawi’s Center for Human Rights and Rehabilitation, with input from several African organizations and international organizations with a presence in Africa.

“Instead of retreating from important achievements to limit impunity, advance the rule of law, and promote respect for human rights, African governments should remain steadfast in supporting justice for victims of the worst crimes by rejecting immunity before the African Court,” said Angela Mudukuti, international criminal justice project lawyer at the Southern Africa Litigation Centre.

Arrestations de deux ex-officiers rwandais: l’armée s’explique

Cette semaine, coup sur coup, l’armée rwandaise a annoncé l’arrestation de deux de ses anciens officiers, le général Frank Rusagara et le capitaine David Kabuye, tous deux à la retraite. Ils seraient soupçonnés de crimes mettant en cause la sécurité de l’Etat, a indiqué le général Joseph Nzabamwita, porte-parole de l’armée, à des journaux locaux, insistant sur le fait que les deux hommes étaient innocents jusqu’à ce que leur culpabilité soit prouvée.

Plus que sur le motif des arrestations de Frank Rusagara et David Kabuye – des enquêtes seraient toujours en cours – le porte-parole de l’armée rwandaise a insisté auprès de la presse locale sur le fait que la procédure a été respectée, que les familles ont été dûment notifiées.

« Aucun membre de famille ne s’est plaint des arrestations », leur a assuré le général Joseph Nzabamwita ajoutant qu’« ils n’ont aucun problème avec les préoccupations de nos institutions ». Toujours dans l’entretien publié par la presse locale, le porte-parole de l’armée a conclu sur ce point : « ils sont nos frères et nos soeurs. »

« C’est assez cynique, commente un militant rwandais des droits de l’homme en exil, on ne peut pas se plaindre au Rwanda, surtout pas quand un proche est arrêté, on risque de lui causer davantage d’ennuis, voire même de suivre le même chemin. » Jusqu’à présent, effectivement, seul David Himbara qui avait refusé dans un premier temps de s’exprimer, a posté un commentaire indigné sur le réseau social Facebook : « Pourquoi Frank Rusagara est-il en prison ? Parce que la révolution mange ses enfants », écrit cet ancien conseiller du président Kagame, aujourd’hui en exil, prédisant que d’ici à la présidentielle de 2017, d’autres arrestations du même type auront lieu.

« Nous avons des préoccupations de sécurité nationale comme n’importe quel autre pays », explique une source officielle rwandaise ajoutant que « ce n’était pas à la communauté internationale – qui a fermé les yeux en 94 – ou à David Himbara d’expliquer au gouvernement ce qu’il doit faire pour assurer la sécurité de ses concitoyens. »

Kagame’s former security head,diplomat arrested over ‘subversion’

Kigali, Rwanda-Brig Gen.Tom Byabagamba, the former President Paul Kagame’s head of the Republican Guard has been arrested for allegedly committing state security offences, Great Lakes Voice has learnt

Brig Gen. Byabagamba was arrested last night; sources told Great Lakes Voice he was arrested trying to rescue his wife Mary Baine from Police intense questioning.

To what sources say its high level intrigue not necessarily linked to Gen Kayumba’s RNC but, simply comments critical to the first family, and opposing government line of thinking. It’s also alleged Gen Frank Rusagara was arrested for almost similar accusations of subversive comments.

Ambassador Mutaboba, Mary Baine and David Kabuye are investigated for the comments made in certain bar in Nyarutarama alleging that First lady, Janet Nyiramongi Kagame may have been involved in Late Inyumba’s death. During the strange statement, after few minutes, they were arrested on spot.

However, sources say Tom Byabagamba was not present but latter came storming CID offices after hearing the news that his wife was at CID for questioning.

Despite news of Brig Gen. Byabagamba’s arrest being in the public domain, police and army officers were evasive and none wanted to go on record.

Police spokesperson ACP Damas Gatare feigned ignorance when contacted about the matter on Sunday evening. He told Great Lakes Voice to cross checking with the army.

“For Mutaboba, you can ask Foreign affairs Ministry and others you can ask army spokesman. You will bear with me; I am not aware of the case,” Gatare said.

The army could not help the matter during press time as the cell phone of army Spokesperson, Brig Gen. Joseph Nzabamwita went unanswered for hours.Tom Byabagamba1

Byabagambi is a brother to Dr. David Himbara who fall out with Kagame recently and turned critic to Kigali establishment. Himbara, who acted as Kagame special adviser on economic policy lived in South Africa then left to Canada after fleeing Kigali in 2011.

His arrest comes after the arrest of Gen Frank Rusagara and Capt David Kabuye on allegations of criminal offences against the state, according to army publicity Brig General Joseph Nzamwita.

Reports from police also indicate that senior diplomat Joseph Mutaboba and Mary Baine have been arrested and conditioned under intense Criminal Investigation Department (CID) questioning. But letter Mary Baine was released after spending the whole night at CID headquarters.

It’s by then Byabagamba was arrested to what Police call ‘obstructing Justice’. Sources say that many more could be arrested by security.

Sources indicate there is a long list of alleged subversive cadres and military officers within the system likely to be arrested one by one to avoid massive arrests at a go.

Amb. Joseph Mutaboba was appointed in 2009 as African Union and United Nations Deputy Joint Special Representative and Deputy Head of the African Union-United Nations Hybrid Operation in Darfur (UNAMID).

Previously the Special Envoy of Rwanda’s President to the Great Lakes region, and Secretary-General in the Ministries of Foreign Affairs and Internal Affairs, he earlier held several senior-level positions as Deputy National Coordinator for Rwanda and Permanent Representative to the United Nations in New York from 1999 to 2001, and as a senior diplomat in Addis Ababa and Washington, D.C.

Mutaboba holds a Master of Philosophy degree in librarian and information science from North London University

East African Community community to create a regional security council: What will it take?

Talks are at an advanced stage to establish the East African Community (EAC) Security Council, which will be charged with ensuring that peace prevails in the region,The Citizen on Saturday has learnt.

All five EAC member states–Kenya, Uganda, Tanzania, Rwanda and Burundi–currently face security threats, with terrorism topping the list. Kenya has borne the brunt of terrorist attacks from Al Shabaab since it sent troops to assist the Somali government in late 2011. The attacks have left hundreds dead and many others injured. Grenades have been hurled into commuter buses, churches have been raided and a big shopping mall was under siege for three days in that country.

Tanzania has also suffered its share of attacks, especially in the tourist hubs of Zanzibar and Arusha. Two blasts rocked Arusha last month alone. In the first attack, a hand grenade was thrown into a residential house in Majengo area and seriously injured two Muslim clerics who were having a pre-fast Ramadhan meal. In the second attack, by an improvised explosive device, eight people were injured at an Asian restaurant near Gymkhana grounds.   In 2008 Tanzania suffered the first major terrorist attack when the US embassy was bombed.

In an interview with this paper yesterday, the deputy minister for East Africa Cooperation, Dr Abdullah Saadalla, confirmed the development and said the security council would make it possible to share information on peace and security matters and also boost peace and security.

Dr Saadalla added: “Yes, we have started talks on establishing a security council. This body will act like the United Nations’ Security Council. It will generally be charged with the responsibility of ensuring that our region remains peaceful and secure.”

The council will also deal with matters such as management of refugee affairs and immigration. But the minister distanced Tanzania from media reports that there was a plan to establish a regional security force. “We in East Africa have not engaged in such talks,” he explained. “Anyone who suggests such a thing must have another basis for forming such a force… we have no plan to do so.”

But, according to Dr Kitojo Wetengere of the Mozambique-Tanzania Centre for International Co-operation, setting up an East African Security Council will help member states address regional security collectively. He argues that the entire region is not safe as long as any of its member states is targeted by terrorists or experiences insecurity.

“First, each member state should take care of its internal security,” he added. “But, most importantly, you need a body which will take care of the regional community, so the move is laudable.”

The don was quick to caution, though, that the proposed security council should be based on fairness for all member states. He added: “We don’t need a security council like that of the United Nations, which has treated its members unfairly. Remember the UN council has turned a blind eye to what is going on in Syria, but it was quick to act in similar conflicts in Iraq and Libya.”

Diplomacy analyst Stanislaus Kigosi, welcomed the move and said it should have come earlier. He pointed out the challenges and warned that if they are not resolved now, it will not achieve its goals. He added: “Trust is a serious issue between EAC member states. We have seen these countries in serious wrangles coming out of security interests. In such situations, the agency might be used by wrangling member states to spy on each other rather than share vital information. Citizens of member states must also be well informed about the threats and how a regional body can help deal with them. These issues are now discussed at top level, but the people must understand the process and back it with their trust.

But city-based political analyst Erick Mwakibete, questions what the mandate of the agency would be in relation to other structures of the EAC. “The summit of head of states is the highest organ now,” he asserted. “Will the proposed Security Council have more say than it? That’s how the UN Security Council operates. Its resolutions are final and very powerful.”

He cautioned that if the new agency is not well organised and empowered, it might end up being another toothless agency in the  community.  He also questioned the scope and future of the EAC.

“If the goal is to form a political federation, then what is the place of the security council?” he added. “We must have plans that concur with our set targets for the integration process to become a success story.”
