Even after the maneuvered Referendum, according to the new Constitution, Paul Kagame’s candidature remains unconstitutional

Notwithstanding the propaganda orchestrated by Paul Kagame team, his ordered constitutional reform followed by the controversial referendum that took place on 18^th of December 2015 and declared won with an historic 98,3% score, Paul Kagame’s reelection remains constitutionally baseless
.
By analytically reviewing the Articles 101 and 172 of the revised Constitution, one realizes that Paul Kagame has no right whatsoever to run a campaign for his third term.
However, during his new year’s message, Paul Kagame has just declared his candidacy for the 2017 upcoming presidential elections, therefore suddenly and definitely making himself an «unconstitutional» candidate.

Subsequently, the leading Team of ISHEMA Party declares the following:

I.Article 101 revised

Before the revision, the article 101 of the 2003 Rwandan Constitution, posited:

«The President of the Republic is elected for a term of seven years renewable only once.

Under no circumstances shall a person hold the office of President of Republic for more than two terms”.

And following is the Article 101 written in the revised Constitution of December 2015:

«The President of the Republic is elected for a five (5) year term. He or she may be re-elected once ».

So far the constitutional reform sets up the sole change from a seven-year to a five-year presidential term whilst maintaining dearly the principle of no more than two terms. It is noteworthy that the simple transition from the seven-year to five-year presidential term does not in any way permit Paul Kagame to run for presidency at the end of his second term.

II. Article 172 newly designed

A unique article was introduced seemingly with the aim to grant Paul Kagame a special status by allowing him the possibility to run for the third term, and tentatively stick with power until 2034. Nevertheless after diverse maneuverings the legal text is more than crystal clear: it simply does not allow Paul Kagame to run for a third term.

Here is the text of the famous Article 172:

« The President of the Republic in office at the time this revised Constitution comes into force continues to serve the term of office for which he was elected.

Without prejudice to Article 101 of this Constitution, considering the petitions submitted by Rwandans that preceded the coming into force of this revised Constitution, which were informed by the particular challenges of Rwanda’s tragic history and the choice made to overcome them, the progress so far achieved and the desire to lay a firm foundation for sustainable development, a seven (7) year presidential term of office is established and shall follow the completion of the term of office referred to in the first paragraph of this Article.

The provisions of Article 101 of this Constitution shall take effect after the seven (7) year term of office referred to in the second paragraph of this Article”.

2.Therefore, this article sets the orders as follows:

A single seven-year term before the implementation of the five-year terms regime
The incumbent president during the constitutional revision shall pursue his term until it is over (2017), this being applicable as well to all members of the parliament in both chambers.

That is all. No paragraph does grant an exception to the current president to run for the third term at the end of the second.

III. The principle of legal non-retroactivity in application

1.The Rwandan Constitution revised in December 2015, published in the official gazette in its special issue on the 24^th December 2015 and implemented from the same day, does not hold the annihilation capacity upon Kagame’s two previous terms. It on contrary recognizes the two terms by confirming that Kagame should pursue his current term. See the first paragraph of Article 172.

2. As such, the revised Constitution having failed to neither create new rights nor exceptional provisions for the incumbent, Paul Kagame’s tentative candidacy must always respect the principle of presidential term limits.

3.Paul Kagame shall not run for the third presidential term constitutionally baseless.

4. For that, by unexpectedly announcing his candidature, eighteen months before future electoral timing, President Paul Kagame is caught red handed in violation of the Rwandan Constitution.

IV. To the International Community, the partners of Rwanda, the organizations of human, civil and political rights as well as all friends of Democracy, we recommend:

1.To take time and re-read analytically the Rwandan Constitution.

2.To Dissuade Paul Kagame in his attempt to violate the Constitution.

3.To assist Rwandans in the struggle to make sure the Constitution is duly respected, to arrest and try Paul Kagame once he stubbornly transgresses against the Constitution.

4.To exercise pressure on Paul Kagame in order to open up the political space, to set free all political prisoners, and to accept the dialogue between the government and the political opposition with the aim to prepare a conducive political environment prior to the elections of 2017.

5.To support the members of ISHEMA Party and New Generation partners in their plans to return and take part in the political life in Rwanda according to modalities set by the congress to be held in Bruxelles from 15^th to 17^th January 2016.

Nyuma y’urusaku rwinshi n’ibinyoma ubutegetsi bwa Paul Kagame bwakwirakwije mu bitangazamakuru mpuzamahanga hagamijwe guhindura Itegeko Nshinga rigenga u Rwanda guhera mu mwaka w’2003, kugira ngo Perezida Paul Kagame abone icyuho cyo kwiyamamariza manda ya gatatu Itegeko Nshinga ritamwemereraga;

Nyuma kandi ya Referendumu ififitse yo kuwa 18 Ukuboza 2015 yakoranywe uburiganya bwinshi bikavugwa ko Itegekonshinga rivuguruye ryatowe na “YEGO” ku majwi 98,3%;

Nyuma yo gusinya no gutanzagaza Itegeko Nshinga rivuguruye mu Igazeti ya Leta yo kuwa 24 Ukuboza 2015;

Tumaze gusomana ubushishozi ingingo zavuguruwe n’inshya zongewe mu Itegeko Nshinga, biragaragarira buri wese ko Itegeko Nshinga rivuguruye naryo ritemerera Paul Kagame kwiyamamariza manda ya gatatu mu mwaka w’2017.

Koko rero iyo usomye ingingo y’ 101 n’iy’ 172 z’iryo Tegeko Nshinga rivuguruye ubona neza ko Paul Kagame nta ruhushya yahawe rwo kuba yahirahira ngo yiyamamariza kuba Perezida w’u Rwanda kuri manda ya gatatu.

Nyamara Paul Kagame mu ijambo yagejeje ku Banyarwanda mu gutangira umwaka wa 2016, yaritanguranyijwe atangaza ko aziyamamaza uko byagenda kose! Naramuka rero abikoze azaba abaye Umukandida utemewe n’Itegeko Nshinga, bityo abe akoze icyaha gikomeye cyane cyo gusuzugura no gutatira Itegeko Nshinga yarahiriye kubahiriza no kurengera.

Kubera izo mpamvu, Ikipe nyobozi y’ishyaka ISHEMA itangarije Abanyarwanda bose, Abanyamakuru ndetse n’Umuryango Mpuzamahanga ibi bikurikira :

I. Ibijyanye n’ihindurwa ry’ingingo ya 101 y’Itegeko Nshinga

1.Mbere y’uko Itegeko Nshinga rivugururwa, ingingo ya 101 yagiraga iti :

“Perezida wa Repubulika atorerwa manda y’imyaka irindwi. Ashobora kongera gutorwa inshuro imwe.

Nta na rimwe umuntu yemererwa gutorerwa manda zirenze ebyiri ku mwanya wa Perezida wa Repubulika”.

Naho ingingo ya 101 mu Itegeko Nshinga ryavuguruwe mu Ukuboza 2015 ,igira iti:

“Perezida wa Repubulika atorerwa manda y‟imyaka itanu (5). Ashobora kongera gutorerwa indi manda imwe”.

2.Biragaragara ko ivugururwa ryakozwe, ari ukuvana manda y’umukuru w’igihugu ku myaka irindwi (7) ikajya ku myaka itanu (5) ariko hakagumaho ihame ridakuka ryo kutarenza manda ebyiri. Bityo rero nibyumvikane neza ko kuvana manda y’umukuru w’igihugu ku myaka irindwi igashyirwa ku myaka itanu, ubwabyo bidaha Paul Kagame uburenganzira bwo kwiyamamariza manda ya gatatu mu gihe azaba arangije manda ze ebyiri mu mwaka wa 2017.

II. Ingingo nshya ya 172

1.Mu biganiro byabanjirije ivugururwa, ingingo nshya iteye ukwayo yatekerejweho ngo ikaba ariyo yari igamije guha Paul Kagame uburenganzira bwo kwiyamamaza kuri manda ya gatatu ndetse ngo ikaba yaragombaga no kumuha uburenganzira bwo gutorerwa kuba umukuru w’igihugu kugeza mu mwaka wa 2034.

Gusa rero nyuma y’inonosorwa, uko iyo ngingo y’172 yasohotse mu Igazeti ya Leta birasobanutse neza nta n’impaka yakagombye kugibwaho : Nta gika cyayo na kimwe cyemerera Paul Kagame kwiyamamariza manda ya gatatu.

Dore uko iyo ngingo ya 172 ivuga :

« Perezida wa Repubulika uri ku buyobozi mu gihe iri Tegeko Nshinga rivuguruye ritangira gukurikizwa akomeza manda yatorewe.

Hatabangamiwe ibiteganywa mu ngingo ya 101 y’iri Tegeko Nshinga, hitawe ku busabe bw’Abanyarwanda bwabaye mbere y’uko iri Tegeko Nshinga rivuguruye ritangira gukurikizwa, bushingiye ku bibazo byihariye u Rwanda rwasigiwe n’amateka mabi rwanyuzemo n’inzira igihugu cyafashe yo kuyivanamo, ibimaze kugerwaho no kubaka umusingi w’iterambere rirambye; hashyizweho manda imwe y’imyaka irindwi (7) ikurikira isozwa rya manda ivugwa mu gika cya mbere cy’iyi ngingo.

Ibiteganywa mu ngingo ya 101 y’ iri Tegeko Nshinga bitangira gukurikizwa nyuma ya manda y’imyaka irindwi (7) ivugwa mu gika cya kabiri (2) cy’iyi ngingo».

2.Nk’uko byigaragaza rero iyi ngingo itegeka ibi bikurikira :

Ko hajyaho manda imwe y’imyaka irindwi (izatangira mu 2017) mbere y’uko manda z’imyaka itanu zitangira gukurikizwa(mu mwaka wa 2024).
Ko Perezida uriho mu gihe cy’ivurururwa ry’iri Tegeko Nshinga akomeza manda yatorewe kugeza irangiye (mu 2017).

Nta kindi cyiyongeraho. Nta ngingo cyangwa igika na kimwe biha Paul Kagame uburenganzira bwo kwiyamamariza manda ya gatatu.

III. Ihame ry’uko amategeko mashya adasenya ibyahise (la non-rétroactivité des lois) rigomba kubahirizwa.

1.Itegeko Nshinga ryavuguruwe mu kwezi k’Ukuboza 2015, rigatangazwa mu nimero idasanzwe y’Igazeti ya Leta kandi rigatangira gukurikizwa tariki ya 24 Ukuboza 2015, ntirisibanganya cyangwa ngo ryirengagize manda Perezida wa Repubulika yakoze mu gihe cyahise. Ahubwo rirazemeza ndetse rigatsindagira ko Perezida uri ku butegetsi agomba gukomeza manda yatorewe kugeza irangiye(2017) nk’uko bigaragara mu gika cya mbere cy’ingingo ya 172.

2.Bityo rero, kuba Itegeko Nshinga ryavuguruwe mu Ukuboza 2015 ritarageneye Perezida uriho (Paul Kagame) uburenganzira bushya cyangwa ngo agirwe irengayobora, ahabwe uburenganzira budasanzwe bwo kwiyamamariza manda ya gatatu, bisobanuye ko ibirebana n’ukwiyamamaza kwe bigengwa n’ihame ndakuka ry’umubare ntarengwa wa manda ebyiri z’umukuru w’igihugu.

3.Niyo mpamvu kuva ubungubu twese dukwiye kumva neza ko Paul Kagame adashobora kongera kwiyamamariza manda ya gatatu. Ukwiyamamaza kwe nta ngingo n’imwe y’Itegekonshinga kwaba gushingiyeho.

4.Igikorwa cya Paul Kagame cyo gutanguranwa agatangaza ko aziyamamaza mu mwaka wa 2017, kandi akabikora amezi 18 mbere y’igihe giteganywa n’amategeko agenga amatora, gikwiye gufatwa nk’igikorwa cy’URUGOMO n’UBUKUBAGANYI, amaherezo kizavamo icyaha gikomeye cyo kwica Itegeko Nshinga. Nakomeza kwinangira umutima bishobora kuzakurura imvuru mu bana b’u Rwanda kandi amategeko azabimuhanira.

IV.Turasaba Umuryango mpuzamahanga, Ibihugu by’incuti n’Abaterankunga b’u Rwanda, imiryango iharanira uburenganzira bwa muntu, amashyirahamwe aharanira iyubahirizwa ry’uburenganzira bw’ubwisanzure muri politiki ndetse n’abakunzi ba Demokarasi aho bari bose ibi bikurikira :

1.Gufata umwanya uhagije bagasomana ubushishozi Itegeko Nshinga ry’u Rwanda nk’uko ryavuguruwe mu Ukuboza 2015.

2.Kwitandukanya na Paul Kagame mu migambi ye yose yo kwica iri Tegeko risumba ayandi mu gihugu .

3.Gufasha Abanyarwanda guharanira ko Itegeko Nshinga ryubahirizwa no gushyikiriza ubutabera Paul Kagame mu gihe yanangira umutima akica Itegeko Nshinga.

4.Gushyira igitutu kuri Paul Kagame kugira ngo afungure urubuga rwa politiki, afungure imfungwa zose za politiki nta yandi mananiza kandi yemere ibiganiro n’abatavuga rumwe na Leta ye hagamijwe gutegura urubuga ruboneye rwa ngombwa mbere y’amatora yo mu mwaka wa 2017.

Reaction to Rwandan President’s Decision To Run for Third Term

The United States is deeply disappointed that President Paul Kagame has announced his intention to run for a third term in office.

With this decision, President Kagame ignores an historic opportunity to reinforce and solidify the democratic institutions the Rwandan people have for more than twenty years labored so hard to establish.

The United States believes constitutional transitions of power are essential for strong democracies and that efforts by incumbents to change rules to stay in power weaken democratic institutions. We are particularly concerned by changes that favor one individual over the principle of democratic transitions.

As Rwanda moves toward local elections this year, presidential elections next year, and parliamentary elections in 2018, we call upon the Government of Rwanda to ensure and respect the rights of its citizens to exercise their freedom of expression, conscience, and peaceful assembly — the hallmarks of true democracies.

The United States remains committed to supporting the free and full participation of the Rwandan people in the electoral processes ahead.

Kubera inyota y’ubutegetsi irenze igipimo Paul Kagame yagaragaje guhera mu 1994, Abacurabwenge ba FPR n’Abanyamategeko banditse Itegekonshinga ryo mu 2003 bararidanangiye ku buryo bashakaga kumufungira inzira kugira ngo atazaguma ku butegetsi ubuziraherezo. Niyo mpamvu bagombye kwandika ingingo y’101 itarashoboraga gupfa guhindurwa bitanyuze muri Referendum. Iyo ngingo igira iti “Perezida wa Repubulika atorerwa manda y’imyaka irindwi. Ashobora kongera gutorwa incuro imwe. Nta na rimwe umuntu yemererwa gutorerwa manda zirenze 2 ku mwanya wa Perezida wa Repubulika”.

Mu mezi ashize, Paul Kagame n’Agatsiko ke bakomeje guteka imitwe mu buryo bunyuranye kugira ngo barebe uko iyi nzitizi y’amategeko yakurwaho bityo akazongera kwiyamamaza mu matora ataha yo mu 2017.

Hari abibwiraga ko ingingo y’172 yashyizweho kugira ngo Paul Kagame akunde agirwe « Irengayobora »(Exception) » bityo azashobore kwiyamamaza manda zirenze ebyiri. Siko bimeze. Iyi ngingo y’172 ntaho yerekana ko Perezida Paul Kagame Kagame ari irengayobora ku buryo yakongera kwiyamamaza bwa gatatu mu mwaka w’2017.

Ahubwo iyi ngingo y’172 igena manda y’imyaka 7 izatangira mu 2017, hanyuma guhera mu 2024 hagatangira kubahirizwa manda y’imyaka itanu. Bivuze ko umunyarwanda wese uziyamamaza kandi agatorerwa kuba Perezida w’u Rwanda mu 2017 azaba atorewe manda y’imyaka 7, yarangira , Perezida akazajya atorerwa manda y’imyaka 5, nk’uko bigenwa n’ingingo y’101 ivuguruye.

Nk’uko mubibona, ntaho bigaragara ko BWANA Pahulo Kagame uzaba urangije manda ze ebyiri, ahawe uburenga-nzira bwo kuziyamamaza mu 2017.

Ikintu kimwe gusa iyi ngingo y’172 yemerera Perezida uriho (Paul Kagame) ni ugukomeza manda yatorewe kugeza mu 2017. Ariko ntabwo imukuriraho ya « KIRAZIRA ».

Bishatse kuvuga ko iyi ngingo y’172 y’Itegekonshinga ryo mu 2015 nayo itamwemerera kuzongera kwiyamamaza.

Perezida Paul Kagame agengwa n’Itegekonshinga ryo mu 2003 yarahiriyeho.

Mu mategeko habaho igitekerenzo-nkingi (Principe) gifite agaciro kangana n’ak’itegeko ryanditse kigena ko « Itegeko rishyirirwaho igihe kizaza ». Mu kilatini bivugwa bitya : « Lex non habet oculus retro ». Abafaransa bo babyita « Principe de la non-rétroactivité des lois ».

Bisobanurako itegeko ryishyirwaho kugira ngo rigenge igihe kizaza. Muri urwo rwego, Itegekonshinga rivuguruye ryo mu 2015 ntirizanywe no gusenya ibyakozwe igihe u Rwanda rwagenderaga ku Itegekonshinga ryo mu 2003. Paris, December 22nd 2015.

1.We have been monitoring closely the malice, tricks, and maneuvering by which Paul Kagame has initiated the constitutional reform and rigged a referendum with the sole aim to allow himself to run again as a presidential candidate come 2017, and with the intention to stay in power until his death.

2.It is extremely saddening to see how the citizens have been forcefully pushed into polls without getting the answers and explanations on articles to be amended and why this should be the case. Furthermore, the project of the constitutional reform was never made public for the citizens to debate. What a terror!

3.The malicious referendum designed and ordered by Paul Kagame himself took place on the dates of 17th and 18th of December 2015. The members of ISHEMA party wanted to participate with two main objectives:

First, we viewed it as the opportunity to get our hands on the constitutional reform project which was up to then held a top secret. Reliable information at our desk noted that the Rwandese Patriotic Front (RPF) clique wanted an « empty project » to be voted first before other disfranchising articles would be added into the constitution.

Second, we aimed at sensitizing the people of Rwanda on the importance of casting their vote and take it as an opportunity to initiate changes they need, want and deserve. It was our due time to express our opinion about the malicious referendum by proudly voting “NO” to the project.

4.The members of ISHEMA Party led by Reverend Father Thomas NAHIMANA went to the Rwandan Embassy in Paris, France, while our partners from the New Generation Coalition led by Jean Damascene Ntaganzwa gathered at the Rwandan Embassy in the Netherlands, all to see themselves refused access to the polling rooms, being told their names were not on the voters’ lists. This is an additional and utmost testimony that the RPF discrimination politics remains standing where some citizens are deprived of their right to vote mentioned in the International Covenant on Civil and Political Rights of which Rwanda is a signatory since April 1975.

5.Members of our Party and other citizens within Rwanda reported to us that on their arrival at the polling stations, they saw their names marked as if they had already voted. Trying to find out why, they were forced back home and told that the amendment must be a hundred per cent voted favorably.

I. We, the Leading Team of ISHEMA Party gathered in our extraordinary meeting in Paris on December 20th 2015 declare the following:

1.No more doubt, Paul Kagame is fully responsible

It is highly immoral to make the world believe that the people of Rwanda want Paul Kagame to remain their leader after 2017. On the contrary, the dictator Paul Kagame made himself author of the project to amend the constitution so that he can stay in power possibly until 2034. For this, two pieces of evidence are overwhelming:

Paul Kagame has never dissuaded those he calls “supporters who want him to stay” although he was well aware that such an action violates the constitution he has himself pledged to protect. Who else can doubt Kagame’s lack of values that must characterize a good leader?

Paul Kagame missed a golden opportunity to stop such a malicious project when the two Chambers of the Parliament tasked him to set up the commission for the constitutional reform. In his person and with no gunpoint at him, Paul Kagame set up the commission to violate the constitution and ordered the plan to follow. He has thus committed the highest act of treason against the Rwandan nation. Kagame shall therefore be held responsible for all the consequences our country is expected to face resulting from his unquenchable thirst for power.

2.This malicious referendum is a curse for Rwanda:

By changing the 2003 Constitution and especially its article 101 that set provisions for peaceful power transfer by preventing anyone to stick with the power after two terms in office;

By forging in the new constitution the article 172 that considers Paul Kagame as an idol president who can only leave the presidency upon death;

3.Rwanda is entering the « Fourth Republic » which reinforces the regime of terror and dictatorship and which has more than much in common with the monarchy abolished since 1961. Under this new monarchy all the powers are put in the hands of the single man, Paul Kagame who believes he cannot leave the power unless he is killed. It should be recalled that the third republic started with the constitution of 2003 that purposely neglected the ARUSHA peace accords that, however, set ways to power sharing as a mean to build sustainable peace among Rwandan citizens.

4.This malicious referendum dispels out all the lies of the RPF:

From now onwards all the claims that president Paul Kagame is a “Supernatural and extraordinary” African Leader who loves democracy and concerned by his people’s peace, security and development are buried. Kagame has finally and truly revealed his real nature: a super dictator with an unending thirst of power. This malicious referendum of his comes as if it was meant to indicate that peaceful political changes are impossible but the determination of peace-lover citizens is still well alive and shall not delay to show. Unfortunately this malicious referendum full of disrespect and provocation towards Rwandans can give a strong reason to those who believe only in armed struggles to resolve the issues. As such, struggles would destroy our country and further deteriorate the already suffering social cohesion.

II. For the abovementioned and other non-listed reasons, we urge all Rwandans;

1.To organize and protest against the malicious referendum that seeks to enthrone the dictator who hails himself into an idol

2.To unanimously stand with all means against the dictator Paul Kagame whose interest is to keep Rwandan citizens into conflicts, wars and poverty which in turn do not allow them to achieve the true welfare and sustainable peace and development.

3.To garner all what it will take and set up the Popular Court of Justice with the mission of trying Paul Kagame over the act of high treason he committed against our nation by this malicious referendum.

4.To start concrete acts of civil disobedience against the regime of Paul Kagame which has no longer any relationship with the people especially now that the malicious referendum has taken the power from the people’s hands in favor of a dictator whose the sole objective is to protect his own interests at expense of the Rwandan’s welfare and all the region’s security.

5.We exclusively call on the armed security forces to ignore Paul Kagame’s manipulations that since long sought to enrich only one man in his person, to kill and to impoverish the armed forces ranks and their colleagues. We urge them to reflect on their mission that aims at neither less nor more than protecting the national sovereignty, order and security of the people of Rwanda. They should stay away from any acts of torturing, terrorizing, mistreating and killing citizens, bearing in their mind that those crimes will soon or later be punished under national or international laws. Shouldn’t they learn from Rwanda’s far and recent past history?

III. To the international community, we recommend

1.To diplomatically, financially and militarily isolate Paul Kagame and his clique. More than enough evidence testifies that the arms and other military materials sold to Kagame in the name of Rwanda are used to terrorize the people and destabilize the security of the whole great lakes region of Africa.

2.To support the political opponents to Kagame’s regime for organization and mobilization so that they keep up their mission to sensitize the Rwandan citizens on peaceful power transfer, good governance and how to reach a government formula that guarantees the true national reconciliation, sustainable peace and shared economic development.

3.To support the Rwandan Consensus Convention which will permit the dialogue between the government of Rwanda and the opposition leaders as well as all key players in national social, economic and political arenas with the sole aim to reach a government of consensus that will prevent further bloodsheds likely to result from Kagame‘s stubbornness and animosity against the open and free political space.

4.To set up an international neutral armed body for protection of the members of the opposition during the presidential campaign and elections of 2017. We request that the international community observers and the Rwandan opposition members be integrated within the national elections commission in order to scrutinize and take part in the planning and the oversight of the elections given the commission’s loss of credibility observed during electoral processes and especially in the most recent malicious referendum.

Conclusion

As Rwandan citizens we must understand that the real change in our country will take place once we decide to contribute. Nobody else shall do it on our behalf.

For that aim, ISHEMA Party decided to organize its congress that will be held from 15th to 18th of January 2016 in order to finalize the plan of the journey to exercise our civic and political rights in Rwanda. Our congress will also take appropriate measures to face the difficult situation Rwanda is entering due to the recent malicious referendum.

L’abbé Thomas Nahimana attaque l’opposition en lançant des mensonges sur RADIO Ijwi Ihuriro Nyarwanda. POUR QUI ROULE-T-IL? FAIT-IL L’OPPOSITION A L’OPPOSITION OU AU SYSTEME FPR?

L’attitude de l’Abbé Thomas Nahimana,Thomas Nahimana qui s’est rendu à Paris pour voter à l’ambassade du Rwanda et légitimer ainsi ce processus frauduleux, illégal et de coup d’Etat constitutionnel me force à sortir de ma réserve. C’est très scandaleux étant donné que Monsieur l’Abbé Thomas NAHIMANA aurait suivi une formation de juriste. Qu’est ce qui peut justifier cet égarement?

La plateforme de l’opposition rwandaise qui compte 5 partis (FDU-IINKINGI, RNC, AMAHORO PC, PS IMBERAKURI et PDP IMANZI) a pourtant sorti une étude juridique assez scientifique qui aurait pu amener l’Abbé Thomas NAHIMANA et son club de copains qui se réclament de la nouvelle génération à réfléchir et à s’inscrire dans la dynamique de l’opposition de dénoncer le processus illégal initié par Paul KAGAME et POUR LUI-MÊME, et dans lequel il a usé de la force et de l’abus de pouvoir pour y entraîner nos comptriotes de l’intérieur de sa prison qu’est le Rwanda actuel. Bravo aux militants et sympathisans de l’opposition qui, au Rwanda, ont suivi les consignes de la plateforme de boycotter tout le processus y compris le réferendum au péril de leurs vies (certains ont même été emprisonnés, d’autres ont refusé des sommes d’argent avancées par le pouvoir). Ce sont des gens courageux à soutenir.

Qu’est ce qui a poussé l’Abbé Thomas NAHIMANA et son club à agir autrement malgré la liberté dont ils jouissent à l’étragner. L’avenir nous donnera sûrement la réponse.

Pendant l’émission de Radio Itahuka, Thomas NAHIMANA n’a pa pu apporter une moindre explication intelligible. Il a tenté d’accuser ses concitoyens de l’opposion de ne rien faire, tentant ainsi de décrédiliser les partenaireséventuels, d’induire en erreur les auditeurs car il semble difficile de croire que Monsieur l’Abbé et son parti ignorent la position de la plateforme des 5 partis d’opposition rendue publique le 14/12/2015 et qui décortique l’illégalité et le caracère frauduleux du processus de modification de la constitution rwandaise qu’il convient tout simplement de boycotter pour ne pas le légitimer.

Dans la position de l’opposition rwandaise que la plateforme a rendue publique, elle formule des recommandations:

“SECTION II. RECOMMANDATIONS

3.2.1. Pour l’intérêt général du peuple rwandais, le président Paul Kagame devrait :

•Terminer son mandat en 2017 et renoncer au renouvellement ;
• Permettre l’ouverture de l’espace politique ;
• Libérer tous les prisonniers politiques ou d’opinion ;
•Réunir une conférence vérité-réconciliation ;
•Déclarer une amnistie générale ;
•Organiser le retour libre des réfugiés ;
•Organiser de véritables élections démocratiques.

3.2.2. Les nouveaux responsables de la scène politique rwandaise devront prioritairement :

•Assurer la sauvegarde de la légalité constitutionnelle ;
•Assurer le respect des lois et des institutions ;
•Construire un véritable Etat de droit où chaque rwandais a le droit d’exprimer librement ses opinions dans le respect de celui des autres ;
•Avoir la liberté et l’égalité des chances quant à la participation à la gestion de la chose publique ;
•Veiller au respect du principe de la séparation des pouvoirs”.

Comment dans ces conditions, l’Abbé Thoams NAHIMANA peut-il affrmer que l’opposition dort et a abandonné les Rwandais sans leur indiquer quel comportement adopter? S’il n’a plus le temps de lire, ni d’équipe de travail pour l’épaule dans l’actualité politique, il devrait se taire.

Dans l’émission de Radio Ijwi Ihuriro Nyarwanda, un certain SIMPUNGA questionne Thomas NAHIMANA, via l’histoire récente du Rwanda, sur son programme de légitimation des élections présidentielles de 2017 et l’interroge sur sa force qui pourrait faire la différence avec les expériences Faustin TWAGIRAMUNGU en 2003 et même Victoire INGABIRE en 2010. Aucune réponse satisfaisante de sa part. Beaucoup d’auditeurs qui sont intervenus dans cette émission croient qu’il serait en mission commandée de légitimer et le processus de modification de la constitution et les élections de 2017.Faute de preuve de cette mission, je n’irais pas jusque là. Mais, comme certains de ses interocuteurs l’ont souligné dans l’émission, il devrait comprendre qu’il peut commettre une erreur d’appréciation politique ou se tromper de stratégie politique par isolement voulu et assumé ou en mission commandée comme le craignent certains rwandais.

Par courtoisie, je me suis gardé de commenter ses pseudoanalyses juridiques lorsque’il justifiait certains actes de Paul KAGAME et de son gouvernement en lançant le processus pour modifier l’article 101 de la constitution.

Force est de constater qu’il ne contetste rien de l’analyse juridique de la plateforme de l’opposition qui a mis à nu tout le processus de modification de la constitution.

Le journaliste lui a fait remarquer qu’il ne pouvait pas non plus ignorer le communiqué de la plateforme de l’opposition signée par Joseph BUKEYE, le leader actuel de la plateforme la veille du scrutin. Un aure interlocuteur lui a rappelé le mémorandum des organistions de la société civile et des partis de l’opposition produit pour dénoncer le processus kagamien de coupt d’Etat constitutionnel.

Touts ces textes pourtant rendus publics ont été ignorés par l’Abbé Thomas NAHIMANA pour se profiler comme le seul homme politique à l’oeuvre en taxant les autres de zombies et de manque de volonté de faire la politique. Un auditeur non avisé croirait que lui et son club sont les seuls valables pour faire de l’opposion au régime de Paul KAGAME.

Ce comportement ne me semble pas digne dans la déontolgie politique et surtout traitant de la sorte des partis qui pourraient être partenaires pour forcer le changement car l’union fait la force à moins que Monsieur l’Abbé Thomas NAHIMANA ne soit en service commandé de Paul KAGAME et de ses sponsors pour occuper le terrain. WAIT AIND SEE.

Tout en encourageant la critique et la rigueur du débat politique, un peu de modestie et de respect pour d’autres acteurs ne nuit pas!!!!

RWANDA REFERENDUM: NE PAS ALLER VOTER, C’EST VOTER EN FAVEUR DU « PRÉSIDENT A VIE »!

Entretien entre l’Abbé Thomas Nahimana, Leader du Parti ISHEMA et la Tribune Franco-Rwandaise(TFR).

TFR : Que pensez-vous du Référendum constitutionnel organisé par le Régime de Kagame en vue de lui permettre de briguer un 3^e mandat présidentiel ?

TN : Le problème n’est pas le Référendum en soi qui est un instrument légal et légitime. Ce Référendum devrait être une belle opportunité pour le peuple rwandais d’exprimer sa volonté contre la dictature insensée et en faveur de la démocratie. Force est de reconnaitre que ce que Paul Kagame et sa clique organisent ne peut pas être un vrai Référendum lorsque le peuple appelé aux urnes ne peut pas voter librement mais plutôt est forcé d’avaliser une loi contre-nature qui va instituer une « présidence à vie » pour un individu qui se croit au- dessus de toute loi, fut-elle constitutionnelle. Mais il nous faut faire la part des choses : aucun cadeau n’étant pas attendu de la part de Paul Kagame et sa clique, il revient au peuple et aux Leaders de l’opposition d’organiser la résistance, par tous les moyens, y compris le vote lui-même.

Jadis un Referendum avait banni la monarchie et instauré la République, il y a 54 ans de cela. Aujourd’hui, avec le 2^e ce Référendum de l’histoire du Rwanda, Paul Kagame n’est pas en train de briguer un troisième mandat présidentiel mais plutôt plusieurs. L’article 167 de la nouvelle Constitution- qui a plutôt les allures d’une vraie « Charte de la tyrannie »- lui donne la voie libre pour rester au pouvoir au moins jusqu’en 2034 ! Cet homme qui se croit à tort être un roi indispensable et irremplaçable devient ainsi un réel danger public, national et international. C’est au peuple rwandais -avec l’aide de la communauté internationale- de prendre ses responsabilités et de rappeler à l’ordre son « homme fort », avant qu’il ne soit trop tard.

TFR : TFR a été informé d’un incident survenu ce matin à l’ambassade du Rwanda à Paris alors que vous vous apprêtiez à voter.

A. Pouvez-vous nous parler de cet incident ?

TN : En réunion des Partis politiques de la coalition dite de « La Nouvelle Génération », nous avons décidé d’aller nous acquitter de notre devoir civique de voter NON à la révision constitutionnelle. Je me suis donc rendu à Paris ce jeudi 17 décembre 2015 accompagné de quelques membres de notre parti. Arrivé à l’ambassade, 12 Rue Jadin, nous nous sommes entretenus avec les policiers français qui assuraient la sécurité du coin, puis avons sonné à la porte. J’ai décliné mon identité et ai présenté mon passeport rwandais. J’ai en outre signalé que j’étais Leader politique issu de l’opposition rwandaise. L’agent d’ambassade qui ne pouvait pas cacher son trouble n’a pas voulu nous laisser entrer prétextant que nous ne figurions pas sur la liste électorale. Pourtant, il n’avait pas cette liste sous la main. Nous avons souhaité vérifier si nous n’étions pas réellement inscrits sur cette liste. Il a carrément refusé ! Devant cette porte de l’Ambassade, sous les yeux de policiers français médusés, nous avons eu un échange houleux avec ce Monsieur et nous avons pu expérimenter le MEPRIS que les agents de Paul Kagame vouent au peuple rwandais en général et aux membres de l’opposition en particulier. C’est très grave.

Je signale qu’un pareil incident est également survenu dans la matinée à l’ambassade du Rwanda au Pays-Bas où Jean Damascène Ntaganzwa Vice-président du Parti UDFR-Ihamye et ses compagnons se sont vu refuser le droit d’entrer à l’ambassade pour voter. C’est dire que l’opposition rwandaise n’a plus le droit de voter. Si les agents du FPR osent nous traiter de la sorte en France et au Pays-Bas, avec quels mépris et méchanceté traitent-ils le peuple sous leur griffes à l’intérieur du Rwanda ?

B. Pourquoi avoir tenu à participer à ce que vos collègues de l’opposition considèrent comme une mascarade ?

TN : Je crois que nous, membres de l’opposition rwandaise de l’extérieure, devrions changer de mentalité et abandonner la politique de la chaise vide qui ne conduit qu’a l’échec et la désolation.

Une élection est toujours une opportunité offerte au peuple. Vous pouvez en faire ce que vous voulez : en profiter ou la laisser filer ! Qualifier une élection de « mascarade » sans même s’être donné la peine d’y participer est un signe de plus d’immaturité politique notoire. Bien pire, faute de motivation ou par peur du risque, certains politiciens prennent le raccourci de prêcher le boycott alors même qu’ils n’envisagent aucune voie de sortie ! Cela ne s’appelle pas faire de la politique, c’est de la lâcheté pure et simple qui conduit à un suicide politique en bonne et due forme ! A quoi servirait-il de s’esquinter en jouant en dehors du terrain ? Allez donc marquer vos très beaux buts, très loin en dehors du terrain !!! On ne peut boycotter un processus électoral auquel on ne participe pas activement. L’opposition burundaise en a fait les fraies à plusieurs reprises ! Et il y en a qui ne comprennent toujours pas ! Arrêtons d’abuser de la patience du peuple en racontant n’importe quoi !

Sachons au moins une chose : le droit de vote est un droit très sacré. Rappelons-nous que, au Rwanda comme ailleurs, des hommes et des femmes respectables se sont battus bec et ongles jusqu’à verser leur sang pour acquérir ce droit. Ainsi, quand un régime même criminel comme celui du FPR appelle le peuple aux urnes, ne pas aller voter est un CRIME CIVIQUE ! Nous savons bien que le FPR organise des élections non pas par conviction démocratique mais parce que, pour une fois, il est liée par des obligations internationales. C’est l’unique opportunité dont le peuple dispose pour administrer une bonne fessée au Dictateur ! Appeler le peuple à ne pas aller voter, c’est faciliter la tâche au Dictateur qui ne manque pas d’avoir très peur du changement à chaque échéance électorale. En l’occurrence, ne pas aller voter NON c’est jouer le jeu de Paul Kagame qui attend toujours d’être sauvé par la lâcheté et la couardise des Leaders politiques de l’opposition qui préfèrent fuir le champ de bataille ! En effet, si 20 % de la population se déplace pour voter (pour Kagame), les élections sont validées au détriment des 80 % de lâches qui ont décidé de rester à la maison. Par leur non-engagement, les 80 % de lâches auront réellement validé le STATU QUO ! A qui cela profite-t-il donc ?

C. Quelle action comptez-vous entreprendre pour dénoncer cette violation flagrante de votre droit d’expression ?

TN : Ce qui est sûr c’est que nous ne resterons pas les bras croisés ! Une réunion d’urgence du Bureau politique du Parti ISHEMA se tiendra ce dimanche 20 décembre 2015, à 20h et décidera d’une vraie stratégie d’action pour les jours avenir. Avec les partis de « La Nouvelle Génération », nous serons à mesure d’organiser une réplique appropriée, et nous vous laisserons le soin de l’apprécier en ses effets. Au-delà d’un Référendum truqué, la politique doit continuer.

D. Pouvez-vous expliquer à nos lecteurs votre décision de retourner au Rwanda, le 28 janvier 2016, afin de vous présenter comme candidat à l’élection présidentielle de 2017 contre le Président sortant Paul Kagame ?

TN : Que voulez-vous que j’explique ? Paul Kagame ne partira pas s’il n’est pas évincé ? Or, il n’y a que deux voies pour réussir une telle éviction : la voie des armes et celle des urnes. N’étant pas armés pour le moment, notre coalition de partis de « La Nouvelle Génération » a stratégiquement opté pour la voie des urnes. La voie de la non-violence reste pour nous la meilleure des options. De fait, nous ne sommes pas aveugles, nous n’ignorons pas que cette voie est trop dure au vu des crimes et agissements dont notre adversaire est capable. En revanche, nous ne sommes pas du nombre de ceux qui cherchent le salut dans la fuite, voilà tout.

E. Pensez-vous comme certains que votre candidature sert à légitimer des élections gagnées d’avance par Kagame ?

TN : Seuls les lâches, les amateurs et les propagandistes du FPR peuvent adopter un raccourci aussi mortifère ! Aucun politicien avisé ne peut succomber à une telle erreur de jugement. Ceux qui professent une telle contre-vérité sont mathématiquement du camp de Paul Kagame et ils ont pour mission de tuer dans l’œuf toute tentative d’organisation de l’Opposition. Comment le Dictateur Kagame pourra-t-il déguerpir si personne ne l’évince ? Ne me croyant être ni lâche, ni amateur, ni propagandiste du FPR, je vais donc mon chemin. Seule l’histoire jugera notre action.

Pour de vrai, ceux qui « légitiment des élections gagnées d’avance par Kagame » sont les lâches qui laissent Kagame seul dans le jeu et n’essaient aucunement de lui barrer la route. En cela, je salue avec respect le courage et l’action de Madame Victoire INGABIRE UMUHOZA qui doit être libérée sans délai et sans condition aucune. Et je m’inscris avec fierté dans la continuité de l’engagement citoyen qu’elle a entrepris.

8.Agasuzuguro Intore n’Inkotanyi bagaragariza Abanyarwanda ntikakiri ako kwihanganirwa. Bageze rwose aho bumva ko aribo Benegihugu bonyine abandi twese tukaba turi nk’imbeba mu maso yabo! Ntidushobora gukomeza kubika umutwe nk’ibihwagari imbere y ’ akarengane n ‘ Agasuzuguro kangana gatya. U Rwanda ntirukeneye umutegetsi w’umwicanyi nka Paul Kagame , uhindukira akigira n’ Ikigirwamana. 11.Banyarwandakazi, Banyarwanda, ushaka inka aryama nkazo : uburenganzira buraharanirwa ! Niba mudahagurutse ngo twange agasuzuguro turi benshi, nimukenyere mwisubirire mu buja n’ubugaragu kuko nyine uwigize agatebo ayora ivu!

Un référendum controversé au Rwanda

Jeudi et vendredi, les Rwandais vont se prononcer sur une modification de la constitution. Une manoeuvre du président Kagame? L’opposition dénonce un manque de débat démocratique.

La consultation populaire va durer deux jours au Rwanda. C’est demain et vendredi que se tiendra le référendum sur les modifications de la constitution. Le parti au pouvoir espère une large victoire du « oui », afin de permettre au président Paul Kagame de briguer un troisième mandat en 2017 – ce que la constitution actuelle ne lui permet pas. L’opposition, elle, dénonce une manœuvre destinée à empêcher l’alternance politique.

Pétition quasi-obligatoire

Plus de 3 millions et demi de Rwandais ont signé il y a quelques mois la pétition lancée par la mouvance présidentielle, pour réclamer la modification de la loi fondamentale. Pour le parti de Paul Kagame, c’est la promesse d’une victoire écrasante du « oui », par la volonté du peuple. Parmi les dispositions les plus importantes contenues dans le projet soumis à référendum, il y a la possibilité faite au président de faire jusqu’à cinq mandats d’affilée. Paul Kagame pourrait donc se représenter pour un nouveau septennat en 2017, briguer ensuite encore trois mandats de cinq ans et ainsi cumuler 31 ans à la tête du pays.

Le caricaturiste Said Michael se fait l’écho des craintes au sein de l’opposition et à l’étranger, sur les ambitions du président Kagame

Le hic, c’est que la campagne a été entièrement orchestrée par le pouvoir, d’après ce journaliste, Gonza Muganwa :

« Le référendum ne sera pas une véritable décision politique du peuple. Officiellement, il n’y a pas de voix discordante. Le parti au pouvoir et ses alliés dominent totalement le paysage politique. »

La chef de la diplomatie européenne, Federica Mogherini a aussi mis en garde début décembre contre la modification d’articles pour les besoins d’un seul individu, qui affaiblirait la crédibilité de la réforme constitutionnelle. Les Rwandais qui sont contre la modification de la constitution préfèrent s’exprimer de façon anonyme, comme ceux-ci:

« Nous n’osons rien dire car ça mettrait notre vie en danger. Des gens ont déjà été emprisonnés, persécutés ou ont tout bonnement disparu. »

« Kagame a dit qu’il ne se présenterait que deux fois. Ce vote est un mensonge. »

Une opposition désenchantée

Le Parti Vert démocratique, seul parti d’opposition indépendant, a pris la tête de la contestation du référendum. Il réclame l’alternance, à la fin du mandat de Paul Kagame, en 2017. Sa plainte devant la cour suprême pour faire annuler le référendum a échoué. Carine Maombi, des Verts, regrette que la date du scrutin n’ait ensuite été confirmée qu’il y a une semaine. Les campagnes de sensibilisation à la modification de la constitution se sont ainsi déroulées sans débat contradictoire.

Par ailleurs, de nombreux Rwandais sont favorables au maintien de Paul Kagame à la présidence. D’une part en raison de la période de croissance économique qui a suivi le génocide de 1994, mais aussi parce que le président n’a pas préparé son éventuelle succession. Pour l’heure, en face de lui non plus, il n’y a pas de rival capable de lui tenir tête aux prochaines élections.
